Our client was charged with care or control and over 80. They were found intoxicated in the sleeper cabin of the tractor trailer when police arrived.
Result: At trial, it was established that the back of the trailer is meant to be a living/sleeping quarters, the vehicle had been completely stationary for nearly 24 hours, the driver had no intention of driving and there was no risk that the vehicle would be set into motion. The court held that our client was not guilty and the charges were DISMISSED.
